Possession of Marijuana II- Class A Misdemeanor
This is probably the most common drug-related charge. Today, many people don’t consider smoking a little weed to be morally wrong. However, I assure you that the police and the judges in South Alabama are concerned with the law — not personal morality. Just because it does not seem like a big deal to you does not mean that the court is going to see it that way. POM II (Possession of Marijuana II) is a Class A Misdemeanor which means that it carries up to one year in the Baldwin County jail and a fine of up to $6000 for the first offense.
Possession of Marijuana I- Class D Felony
In Alabama, a second conviction for possession of marijuana for personal use (see POM II above) becomes a Class D Felony, which means that the possible penalty bumps up to a potential five years in the AL State penitentiary. As I said above, you may not think a little weed is a big deal, but Alabama does.
